{"id":107,"date":"2010-09-07T16:42:13","date_gmt":"2010-09-07T23:42:13","guid":{"rendered":"http:\/\/www.lorennwalker.com\/blog\/?p=107"},"modified":"2010-09-07T16:42:13","modified_gmt":"2010-09-07T23:42:13","slug":"lawyers-promote-restorative-justice-therapeutic-jurisprudence","status":"publish","type":"post","link":"https:\/\/www.lorennwalker.com\/blog\/?p=107","title":{"rendered":"Lawyers promote restorative justice &#038; therapeutic jurisprudence"},"content":{"rendered":"<p class=\"MsoNormal\">\n<p class=\"MsoNormal\" style=\"line-height: 200%;\"><span style=\"font-family: Arial;\"><!--[if !supportEmptyParas]--><!--[endif]-->While a lot of \u201clawyer dissing\u201d goes on, some of it easily understandable, many lawyers and judges (who are also lawyers) should be recognized for promoting restorative justice and therapeutic jurisprudence.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 200%;\"><span style=\"font-family: Arial;\">Judge Gordon McConnell was instrumental in the first modern restorative justice case. John Braithwaite, in <a href=\"http:\/\/www.us.oup.com\/us\/catalog\/general\/subject\/Law\/CriminologyandCriminalJustice\/?view=usa&amp;ci=9780195158397\"><em>Restorative Justice and Responsive Regulation<\/em><\/a><\/span><span style=\"font-family: Arial;\">, cites a paper by Peachy, D.E., 1989, \u201cThe Kitchener Experiment\u201d In<em> Mediation and Criminal Justice: Victims, Offenders and Community<\/em><\/span><span style=\"font-family: Arial;\">, edited by M. Wright and B. Galaway, London: Sage, describing the first case in the modern restorative justice movement. Others have also said that this 1974 case, which occurred in the town of Elmira near Kitchener, in Ontario, Canada, was the beginning of <a href=\"http:\/\/www.vorp.com\/articles\/art.html\">\u201cvictim offender mediation.\u201d<\/a><\/span><span style=\"font-family: Arial;\"><a href=\" http:\/\/www.sfu.ca\/crj\/kelly.html  \"> Russell Kelly has written a fascinating description<\/a> of this first case explaining he committed the crimes and was a teenager at the time committed.<\/span><span style=\"font-family: Arial;\"> Mr. Kelly and another other young friend were intoxicated and decided to \u201craise some hell\u201d by randomly slashing tires and seriously vandalizing parked cars.<span> <\/span>He describes how his insightful probation officer Mark Yantzi thought it would be more meaningful for the two teens to personally meet with the 22 victims of their crimes instead of going to jail. Probation officer Yantzi convinced Judge <span class=\"bodytext\">McConnell,<\/span> who presided over the criminal case, to allow the teens to address their crime restoratively.<span> <\/span>The two teens went into the homes of the 22 victims, which Mr. Kelly describes as \u201cone of the hardest things I had ever done in my life.\u201d The teens also made plans for reparation with the victims that they followed through with and avoided jail time.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 200%;\"><span style=\"font-family: Arial;\">Since 1974 and Judge McConnell\u2019s support for a restorative solution, other judges have promoted these types of interventions in criminal cases including <a href=\"http:\/\/www.paroleboard.govt.nz\/\">David Carruthers <\/a>head of the New Zealand parole office; <a href=\"http:\/\/www.livingjusticepress.org\/index.asp?Type=B_BASIC&amp;SEC={7B819901-B279-4B96-ABB9-BCF7377EE0A8}&amp;DE={A6202A49-58E7-4211-A84D-BCAA3560A6F9}\">Barry Stuart <\/a>a Canadian judge and co-author of the book <em>Peacemaking Circles: From Crime to Community<\/em><\/span><span style=\"font-family: Arial;\">; <a href=\"http:\/\/en.wikipedia.org\/wiki\/Janine_P._Geske\">Janine Geske<\/a> from Wisconsin; <a href=\"http:\/\/www.legaltrends.net\/users\/michael-town \">Michael Town<\/a> and <a href=\"http:\/\/www.courts.state.hi.us\/courts\/district\/judges\/judge_leslie_a_hayashi.html\">Leslie Hayashi <\/a>from Hawai\u2019i, are all examples of judges who have promoted restorative justice. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 200%;\"><span style=\"font-family: Arial;\">Other lawyers who have furthered the restorative justice movement include <a href=\"http:\/\/www.restorativejustice.org\/RJOB\/RJOB\/contributorbios\/dan-van-ness\/\">Daniel Van Ness <\/a>author of many publications; <a href=\"http:\/\/www.lorennwalker.com\/blog\/?p=102\">Mario Ottoboni <\/a>who conceived of the idea of restorative prisons in Brazil; <a href=\" http:\/\/www.lorennwalker.com\/blog\/?p=53\">Sunny Schwartz <\/a>author of <em>Dreams of the Monster Factory<\/em><\/span><span style=\"font-family: Arial;\">; and<a href=\"http:\/\/www.nyu.edu\/about\/leadership-university-administration\/office-of-the-president\/office-of-the-provost\/university-life\/bios\/linda-mills.html\"> <\/a><a href=\"http:\/\/www.nyu.edu\/socialwork\/our.faculty\/linda.mills.html.\">Linda Mills <\/a>New York University professor and author of many publications.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 200%;\"><span style=\"font-family: Arial;\">And it was two lawyers who became law professors, <a href=\" http:\/\/en.wikipedia.org\/wiki\/Therapeutic_jurisprudence \">David Wexler and the late Bruce Winick, that co-founded therapeutic jurisprudence<\/a>, <\/span><span style=\"font-family: Arial;\">which is the foundation for drug and specialty courts throughout the world. <a href=\"http:\/\/www.lorennwalker.com\/blog\/?p=88 \">A bench book for courts by former Australian judge Michael King<\/a><span> <\/span>is available on line: <span style=\"color: black;\"><a href=\"http:\/\/www.aija.org.au\/Solution%20Focused%20BB\/SFJ%20BB.pdf\">http:\/\/www.aija.org.au\/Solution%20Focused%20BB\/SFJ%20BB.pdf<\/a><span> <\/span>J. Kim Wright a lawyer started the <a href=\"http:\/\/www.cuttingedgelaw.com\/node\">Cutting Edge Law website<\/a>, which provides resources for people who envision a positive response to: <em>\u201cWhat if Lawyers were Peacemakers, Problem Solvers and Healers of Conflicts?\u201d<\/em><\/span><\/span><\/p>\n<p class=\"MsoNormal\" style=\"line-height: 200%;\"><span style=\"font-family: Arial;\">Of course there are many other judges and lawyers, and many people who are not judges and lawyers, who have helped promote restorative justice and therapeutic jurisprudence.<span> <\/span>These are simply examples of lawyers who have helped advance these interventions to improve our justice system.<\/span><\/p>\n<p><!--EndFragment--><\/p>\n","protected":false},"excerpt":{"rendered":"<p>While a lot of \u201clawyer dissing\u201d goes on, some of it easily understandable, many lawyers and judges (who are also lawyers) should be recognized for promoting restorative justice and therapeutic jurisprudence.
